1. Acceptance of Terms
By accessing or using MogliMart ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
MogliMart is operated by Moglimart Solution OPC Pvt Ltd ("Company", "we", "us", or "our"), a company registered in India. These Terms apply to all users, including customers, sellers, and delivery partners.
2. Eligibility
- You must be at least 18 years old to use MogliMart
- You must provide accurate and complete information during registration
- You are responsible for maintaining the confidentiality of your account
- You must not use the Platform for any illegal or unauthorized purpose
3. User Accounts
3.1 Registration
You can register as a Customer, Seller, or Delivery Partner. Each role has specific requirements and responsibilities.
3.2 Account Security
- You are responsible for all activities under your account
- Notify us immediately of any unauthorized access
- Do not share your OTP or login credentials with anyone
3.3 Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the Platform.
4. Orders and Payments
4.1 Placing Orders
- All orders are subject to availability and acceptance by the seller
- Prices are set by individual sellers and may vary
- You can choose from three delivery modes: Same Day Delivery (by delivery partner), Seller Self-Delivery (seller delivers himself), or Pick Up from Shop (collect yourself)
- Delivery charges and taxes are displayed before checkout
- We reserve the right to refuse or cancel orders for any reason
4.2 Payment
- We accept UPI, credit/debit cards, net banking, and cash on delivery
- All payments are processed securely through third-party gateways
- You authorize us to charge your payment method for orders placed
4.3 Refunds and Cancellations
- Cancellations are allowed before the order is confirmed by the seller
- Refunds for cancelled orders will be processed within 5-7 business days to the original payment method
- Damaged, incorrect, or missing items can be reported within 24 hours of delivery
- For Pick Up orders, cancellations are allowed until you collect the order
- Refund eligibility is determined on a case-by-case basis by our support team
5. Seller Terms
5.1 Seller Obligations
- Provide accurate product information, pricing, and availability
- Fulfill orders promptly and ensure product quality
- Comply with all applicable laws and regulations
- Maintain valid KYC documents and business licenses
5.2 Commission
MogliMart charges a commission on each successful order. Commission rates are communicated during onboarding and may be updated with prior notice.
5.3 Payouts
Seller earnings are settled weekly to the registered bank account, minus applicable commissions and fees.
6. Delivery Partner Terms
- Delivery partners are independent contractors, not employees of MogliMart
- You must have a valid driver's license and vehicle insurance (for two-wheeler/four-wheeler deliveries)
- Earnings are based on completed deliveries, distance, and incentive programs
- You must maintain professionalism, adhere to delivery timelines, and handle products with care
- Real-time location tracking is required during active deliveries for customer transparency
- You can accept or reject delivery requests based on your availability
7. Prohibited Activities
You agree not to:
- Use the Platform for fraudulent or illegal purposes
- Violate any laws or regulations
- Harass, abuse, or harm other users
- Attempt to gain unauthorized access to the Platform
- Upload malicious code, viruses, or harmful content
- Scrape, copy, or reverse-engineer the Platform
- Impersonate others or provide false information
- Interfere with the Platform's operation or security
8. Intellectual Property
All content on MogliMart, including logos, trademarks, text, graphics, and software, is owned by Moglimart Solution OPC Pvt Ltd or its licensors.
You may not reproduce, distribute, modify, or create derivative works without our written permission.
9. Disclaimer of Warranties
MogliMart is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:
- Uninterrupted or error-free operation
- Accuracy or completeness of content
- Product quality (sellers are responsible for their products)
- Delivery timelines (subject to external factors)
10. Limitation of Liability
To the maximum extent permitted by law, MogliMart and its affiliates shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Damages arising from seller or delivery partner actions
- Damages exceeding the amount paid for the relevant order
11. Indemnification
You agree to indemnify and hold harmless Moglimart Solution OPC Pvt Ltd, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.
12. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Noida, Uttar Pradesh, India.
13. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes constitutes acceptance.
